Terms and conditions

1. Who we are

This website and the shop on it are run by:

Edmosphere Holding B.V.
Heistraat 20
5351 PP Berghem
The Netherlands
Chamber of Commerce (KvK) number: 55704565
VAT identification number: NL851825898B01
E-mail: boeken@nieuwenhuyse.nl

Below, “we” means Edmosphere Holding B.V. and “you” means the customer.

2. What these terms apply to

These terms apply to every order you place through nieuwenhuyse.nl. You see them before you pay and you can save or print them. At checkout we ask you to agree to them; without that, the order cannot be completed.

On this site we sell digital products to consumers only. If you buy as a business, the provisions on the right of withdrawal in article 7 do not apply, because that right is given to consumers only.

3. What you are buying

You are buying an e-book that you download yourself. Every order gives you the same book in two file formats:

  • EPUB, for e-readers, phones and tablets;
  • PDF, for reading on a computer or for printing.

You are buying a right to use the book, not the copyright. See article 9.

If we offer a title free of charge, these terms apply in full except for the provisions about payment. A free book is still protected by copyright and article 9 still applies.

You can read and download a free sample of the book before buying anything. We recommend doing so: then you know whether the book and the file formats suit you.

4. Prices

The price is shown with the product and includes VAT. E-books are subject to the reduced Dutch VAT rate of 9 per cent. At checkout the VAT amount is shown separately. There are no shipping charges or other costs.

We may change prices, run temporary promotions and issue discount codes. We may also offer a title free of charge. The price that applies to your order is always the price shown with the product at the moment you ordered. You cannot derive any rights from an earlier or later price, or from a promotion that has ended.

If a price is obviously wrong because of a mistake – a typing error, a decimal point in the wrong place – we are not obliged to deliver at that price. We will contact you and refund whatever you paid.

5. How the purchase is concluded

  1. You put the book in your basket and go to the checkout page.
  2. You enter your name and e-mail address. You do not need to create an account.
  3. You agree to these terms.
  4. You pay.
  5. We send you a confirmation by e-mail. At that moment the purchase is concluded.

We may refuse an order or refund a payment if we have good reason to believe something is wrong. We will tell you if we do.

6. Payment and delivery

Payment is handled by Mollie B.V., our payment service provider. The available payment methods are shown at checkout. Your payment details go directly to Mollie; we never see them.

As soon as the payment has gone through, two things happen:

  • you land on a confirmation page with the download buttons;
  • you receive an e-mail with the same download links.

The download links remain valid for two years and each file can be downloaded **five times**. Download the files straight away and keep them somewhere you will find them again; they are then yours, even if this website should one day cease to exist.

If the e-mail does not arrive, check your spam folder first. If it is not there either, send us a message at boeken@nieuwenhuyse.nl from the address you ordered with and we will resend the links.

If your downloads have run out or expired and you bought the book honestly, we will reset the counter on request. We will not be difficult about it.

7. Cooling-off period and withdrawal

You have fourteen days to change your mind, including on the e-book.

Dutch law allows us to take that period away for digital products delivered immediately, by having you expressly waive your right of withdrawal in advance (article 6:230p under g of the Dutch Civil Code). We deliberately do not do this. You keep your cooling-off period.

In practice:

  • The period is fourteen days, counted from the day after you placed the order. Not from the moment you download or start reading.
  • You cancel the purchase by telling us within that period at boeken@nieuwenhuyse.nl. An ordinary e-mail is enough. You do not have to give a reason.
  • You may also use the model withdrawal form on the page cooling-off period and right of withdrawal. You are not obliged to.
  • You get the full amount back, by the same payment method, within fourteen days of your message reaching us. We deduct no costs.
  • We ask you to delete the files from your devices. Your download links stop working after the refund.

The right of withdrawal is given to consumers only. If you buy in the course of a business or profession, this cooling-off period does not apply.

None of this affects article 8: if a product is faulty you keep your rights, including after those fourteen days.

8. If something is not right

You are entitled to a product that does what you may reasonably expect of it. If a file does not work, is damaged, or part of the book is missing, let us know at boeken@nieuwenhuyse.nl. We will sort it out: first by supplying or repairing the file, and if that fails, you get your money back.

We cannot guarantee that the files will work on every conceivable device or in every reading app. EPUB and PDF are open standards that work almost everywhere, but some devices impose their own requirements. If you get stuck, e-mail us; we are glad to help.

What we also cannot promise is that the book will help you. It is a book, not therapy and not medical advice. If something is seriously troubling you, please see your doctor or another professional.

9. Copyright and what you may do with the book

The text, the cover and the design are protected by copyright, which remains with the author.

What you may do:

  • read the book as often as you like;
  • put the files on your own devices – e-reader, phone, tablet, computer;
  • make a backup copy;
  • print the book for your own use;
  • quote from it, with attribution, as the law permits.

What you may not do:

  • forward, upload or otherwise distribute the files;
  • put them on a website, in a file-sharing service or in a group chat;
  • resell or rent out the book;
  • reproduce the text in whole or in large part in something else, or use it to train a language model or any other system.

There is no copy protection on the files. That is a deliberate choice: copy protection mainly gets in the way of honest readers. We trust you to treat it decently. If you want to give the book to someone, please buy a second copy – it is the most direct way to support a writer without a publisher.

Use within an organisation, in education or for a larger group requires a separate arrangement. E-mail us; we always work something out.

10. Complaints

If you have a complaint, e-mail boeken@nieuwenhuyse.nl. Describe as clearly as you can what the problem is. We will respond substantively within fourteen days. If we cannot, we will tell you within that period when you can expect an answer.

If we cannot resolve it together, you may bring the matter before the competent Dutch court. Consumers in the Netherlands can also turn to Het Juridisch Loket or their legal expenses insurer.

11. Liability

We are liable for damage resulting from our failure to perform, to the extent provided by law. We are not liable for damage caused by your using the files incorrectly or failing to keep them, nor for the consequences of decisions you take on the basis of what you read in the book.

Nothing in these terms limits your mandatory rights as a consumer. Where a provision would conflict with those rights, the law prevails.

12. Changes

We may change these terms. The version that applies to your order is the one that was on the site at the moment you ordered. So keep your order confirmation; it carries the date.

13. Governing law

These terms and every purchase are governed by Dutch law. If you live in another EU country, you retain the protection of the mandatory consumer rules of your own country.
